Terms & Conditions (AGB) – Hen Alfi & Ami Zarug

1. Role of the Parties & Contractual Partner

1.1. Design & Platform: Hen Alfi (The Provider) operates this website as a creative studio and conceptual designer. 1.2. Contractual Partner: By placing an order, the Buyer enters into a sales contract directly and exclusively with the executing artisan, Ami Zarug, located in Israel (The Seller). Hen Alfi facilitates the design and communication but is not a party to the sales contract, nor the seller or importer of the physical goods.

1.3. Exclusion of Withdrawal Rights: Pursuant to Section 312g (2) No. 1 BGB, the right of withdrawal is excluded for custom-made artistic goods produced to customer specifications. All sales are final once production has commenced.

2. Intellectual Property & Artistry

2.1. Ownership: Hen Alfi retains all intellectual property rights to the original designs and concepts created by him. 2.2. Artistic Variations: Each product is a handmade, unique piece of art. The Buyer acknowledges that handcrafted artworks involve natural variations in color, texture, shape, and finish. These are an integral part of the artistic process and do not constitute defects.

2.3. Third-Party Claims: The Seller (Ami Zarug) is responsible for ensuring that physical production does not infringe upon third-party rights. Hen Alfi assumes no liability for infringements arising from production or unauthorized modifications by the Seller.

3. Shipping, Customs & Force Majeure

3.1. Origin & Terms: Goods are shipped directly from Israel on an EXW (Ex Works) basis.

3.2. Customs: The Buyer is the "Importer of Record" and is solely responsible for all international customs duties, import VAT, and local fees. Hen Alfi is not responsible for delays or seizures by customs authorities.

3.3. Unboxing Video: To process any insurance claim for damage during transit, a continuous, unedited unboxing video is mandatory.

3.4. Force Majeure: Neither the Provider nor the Seller shall be liable for delays or failure to perform resulting from causes outside their reasonable control, including but not limited to acts of war, regional conflicts, or port disruptions in Israel.

4. Material Safety & Liability

4.1. Usage: Items are for decorative/editorial use only. They are not toys and are not fire-resistant.

4.2. Limitation of Liability: Hen Alfi’s liability is limited strictly to the provision of design services. To the maximum extent permitted by law, any liability regarding production defects, shipping damages, or handling lies exclusively with the Seller (Ami Zarug).

5. Governing Law & Jurisdiction

5.1. Design Services: Terms regarding Hen Alfi’s services are governed by the laws of Germany. Jurisdiction: Berlin.

5.2. Sales Contract: Disputes arising from production, sale, or delivery are subject to the laws and jurisdiction of the State of Israel.
